EMUES

1. www.emues.com is a social network and an online platform where Fans, Artists and Venues can meet and which brings you as a Venue the opportunity to decide who’s on stage in what city. When enough tickets are sold, the gig is on!
2. www.emues.com is offered to you conditioned to your acceptance without alteration of these Terms and Conditions. These Terms and Conditions are applicable when you register as a Venue and when you suggest, accept or decline concerts through www.emues.com.

1. By pressing the “I Accept” box when register as a Venue on www.emues.com and/or accepting/declining suggested concerts, you agree on these Terms and Conditions and confirm that the information submitted by you is true, accurate and complete. You also confirm that you are 18 years of age or more.
2. It is your obligation to update the information submitted on www.emues.com in order to keep it current.

1. Emues shall work in its Fans, Artists and Venues best interest and undertakes to do its best in order for a suggested concert to become reality. Emues is only a platform and intermediary service between Fans, Artists and Venues and shall not give any guaranties or make any warranties and shall not have any liability for the Venue’s and/or the Artist’s performance or services.
2. When accepting a suggested concert, you also accept that Emues makes no guarantees that the required amount of tickets will be sold and/or that the suggested concert will be booked. Emues undertakes to inform you within reasonable time on www.emues.com when a suggested concert has been accepted or declined by an Artist, or when it is clear that a suggested concert will not be booked.
3. When a suggested concert has been accepted by an Artist and you, and when enough tickets has been sold, a concert will be booked. Any other concert open for sale to the same date as the booked concert will then expire.
4. When a suggested concert is booked, the Fans enter into an agreement with you as organizer for the concert.
5. It is your responsibility to agree on the details of the concert with the Artist.

1. All prices are set by the Artists and Venues. All prices, costs and expenses shall be specified by the Venue when accepting a suggested concert and may thereafter not be altered or increased.
2. Emues will charge the Fan a fee of five percent of the ticket price on all tickets sold through www.emues.com or by the Venue.
3. The Venue shall after a concert inform Emues of the number of concert tickets sold by the Venue and to what price the tickets have been sold.
4. Any sales profit, i.e. any profit made when all the Artist’s and the Venue’s prices, costs and expenses including VAT have been covered (break-even), is divided 50/50 between the Venue and the Artist.

Payment for concerts is made after the concerts, when the Venue has informed Emues in accordance with section 4.3 above.

When you register as a Venue on Emues, you agree on Emues’ Privacy Policy. You agree that Emues is entitled to collect and process your personal information in accordance with Emues’ Privacy Policy applicable from time to time.

1. As a Venue on Emues, you agree on the following (including but not exclusive) commitments:
   1. You will only use Emues for its intended purpose, i.e. suggesting concerts and accepting or declining concerts;
   2. You will not upload viruses or other spiteful code;
   3. You will not bully, harass or intimidate any user on Emues;
   4. You will not use Emues to do anything unlawful, misleading or malicious.
2. In view of the above, if any unacceptable behaviour is discovered, Emues has the right to immediately terminate the agreement and un-register you as a Venue.

All information available on www.emues.com is protected by the copyright act. This means that the content, text, photos, graphic or other material may not be stored, copied or duplicated or in any other way exploited without Emues’ prior written consent.

Technical difficulties or maintenance may cause temporary interruptions on the website www.emues.com. Emues reserves the right to, at any time, adjust or discontinue functions of www.emues.com with or without prior notice.

Emues will not compensate any loss owing to operational interruption or other technical circumstances which make it impossible or difficult to use www.emues.com.

www.emues.com may contain links to other websites on the Internet, which are owned and operated by third parties. This does, however, not imply that Emues is associated with these websites or their proprietors. Furthermore, Emues is not responsible for other parties’ websites and/or their content. Every time you are linked to a third party website, Emues recommend you to review the websites’ privacy policy, and terms and conditions.

1. When accepting a suggested concert, the Venue guarantees that it has such suitable premises, personnel, technical recourses as well as any permits required in order to carry out the relevant concert with such high quality and standard as may be expected from a well reputed concert venue.
2. Should the Venue fail to comply with its obligations pursuant to section 13.1 above and should this give rise to claims against Emues, the Venue shall indemnify Emues and hold Emues harmless against such costs.

These Terms and Conditions will become effective when you have pushed the “I Accept” Box when creating your account. You will be asked to confirm these Terms and Conditions each time you accept or decline a concert.

Emues has the right to make changes to these Terms and Conditions at its sole discretion. It is your responsibility to keep yourself informed of the Terms and Conditions applicable from time to time. If any material changes are made, these will be communicated to you and your acceptance of and/or continued use of Emues services after such notification of changes will constitute your acceptance.

These Terms and Conditions shall be subject to Swedish law. Any disputes with relation to these Terms and Conditions shall be finally settled by the competent Swedish Courts.
